Attig Law Firm helps Veteran get favorable Order from CAVC.

The Attig Law Firm prevailed before the Court of Appeals for Veterans Claims (CAVC) for a peacetime Veteran of the military.

While in service, the Veteran was struck on the head and suffered a severe head injury, which resulted in a Traumatic Brain Injury. Ultimately, the Veteran succeeded in service connecting his TBI and residuals with a 2007 effective date.

The Veteran came to our Firm seeking help persuading the VA that he was entitled to an Earlier Effective Date - the Veteran believed he was entitled to benefits with an Effective Date of 1994.  The Attig Law Firm filed an appeal on behalf of the Veteran with the CAVC; before briefing the appeal to the Court, the case was remanded to the BVA under a Joint Motion to Remand between the Appellant and the VA Office of General Counsel.

On remand, the Board will have to consider the Veteran's entitlement to a 1994 effective date.  Other errors were found in the BVA decision, including failure to properly consider an effective date for a claim for increase, and a failure to assist the Veteran in ensuring that all of his medical records were in the file.

The Firm will continue to represent the Veteran in his remanded effective date claims.
